OVERVIEW
Welcome to Savor Caviar. The terms “we,” “us,” and “our” refer to Savor Caviar. Savor Caviar operates this website and store, including all related information, content, features, tools, products, and services (collectively, the “Services”). By visiting, accessing, browsing, or purchasing from the Services, you agree to be bound by these Terms of Service and our posted policies, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.
1. ELIGIBILITY AND USE
You represent that you are at least the age of majority in your state or province of residence. If you purchase wine or other age-restricted products, you represent that you and the intended recipient are at least 21 years of age and legally permitted to receive such products.
2. PRODUCTS
We make reasonable efforts to describe and display our products accurately. However, product appearance, color, packaging, and presentation may vary. We reserve the right to change, discontinue, or limit any product at any time without notice.
3. ORDERS
An order placed through the Services is an offer to purchase. We reserve the right to accept, reject, limit, or cancel any order in our sole discretion. We may also limit quantities, refuse service, or cancel orders that cannot be legally, operationally, or commercially fulfilled.
4. PRICING, SHIPPING, AND TAXES
Prices are subject to change without notice. Unless expressly stated otherwise, prices do not include shipping charges, handling, taxes, customs, or import fees.
Shipping rates may vary based on destination, package weight and/or order value, service level, and temperature or seasonal shipping conditions. Complimentary shipping, if offered, applies only to qualifying orders and may be modified or discontinued at any time.
Wine or alcohol shipping rates may vary and may be unavailable in certain states or jurisdictions.
5. SHIPPING, DELIVERY, AND RISK
Delivery dates and transit times are estimates only and are not guaranteed. We may delay shipment when, in our judgment, shipping conditions may compromise product quality, including due to weather, carrier disruption, or holiday periods.
Except where required by law or carrier policy, orders other than wine may be shipped without signature at the customer’s request or election. If the customer selects no signature delivery, carrier release, or delivery without direct acceptance, all risk after confirmed delivery passes to the customer, and Savor Caviar is not responsible for theft, loss, delay in retrieval, temperature exposure, spoilage, or product condition affected
after the carrier marks the package delivered.
If a shipment requires a signature or adult signature and the recipient is unavailable or otherwise fails to accept delivery on the first delivery attempt, any resulting delay, re-delivery, storage, hold, or next-day delivery is at the customer’s sole risk. Savor Caviar is not responsible for spoilage, temperature deviation, deterioration, delay, loss, or damage resulting from the recipient’s failure to timely accept the shipment.
Customers are responsible for providing a complete, accurate, and deliverable shipping address. We are not responsible for delay, loss, or unsuccessful delivery resulting from incorrect, incomplete, invalid, or undeliverable addresses provided by the customer.
Except to the extent prohibited by applicable law, title and risk of loss pass to the customer when the order is transferred to the carrier, and in any event no later than confirmed delivery by the carrier.
6. PERISHABLE GOODS / RETURNS / CLAIMS
Many products sold by Savor Caviar are perishable. Claims for damage, spoilage, temperature concerns, missing items, incorrect items, or any other delivery-related issue must be submitted within 24 hours of confirmed delivery in accordance with our Return & Refund Policy.
Returns are not accepted without prior written authorization. Unauthorized returns may be refused and are not eligible for refund, replacement, or credit. We reserve the right to require supporting documentation, including photographs of the box, shipping label, internal packaging, cooling materials, and the product.
All claims, determinations, and remedies are reviewed and issued at Savor Caviar’s sole discretion.
7. WINE RESTRICTIONS
Wine may be sold or shipped only where legally permitted. Wine may require adult signature, age verification, and may be unavailable in certain states or jurisdictions. Wine will not be shipped to a P.O. Box. We reserve the right to refuse, cancel, or limit any wine transaction that cannot be legally or operationally fulfilled.
8. INTELLECTUAL PROPERTY
All content on the Services, including text, graphics, logos, images, product descriptions, page design, and other materials, is owned by or licensed to Savor Caviar and is protected by applicable intellectual property laws. No content may be copied, reproduced, republished, distributed, or exploited without our prior written permission.
9. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, except as expressly stated by Savor Caviar in writing.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Savor Caviar shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss arising out of or relating to the use of the Services, any order, any shipment, carrier delay, weather event, missed delivery, no-signature release, refused delivery, or handling of products after delivery.
11. GOVERNING LAW
These Terms and any disputes relating to the Services or purchases from Savor Caviar shall be governed by the laws applicable in the State of Texas, without regard to conflict of law principles. Venue shall lie in the appropriate courts serving Houston, Texas, unless applicable law requires otherwise.
12. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time by posting a revised version on the website. Your continued use of the Services after any update constitutes acceptance of the revised Terms.
